One of Mississippi’s and the United States’ most inhumane actions was the forced removal of American Indians from the South to lands west of the Mississippi River in the early s. Removal occurred because of an incessant demand for Indian lands. Demands for Indian land resulted from Anglo-American population growth in the South, the expansion of the short-staple cotton industry after Eli Whitney’s cotton gin became widely available in the s, the discovery of gold and other minerals on some Indian land, and simple racism. It did not help Indians that the Louisiana Purchase in provided lands to the west to which the United States could banish them, or that by there was no longer a viable European ally in the area who could counteract American demands. The Mississippi Legislature passed a resolution that went into effect in January extending its jurisdiction over Choctaw and Chickasaw territories within the state.

In the migration myth, two brothers, Chahta and Chikasa, traveled from the West looking for more fertile hunting grounds. Each night they planted a pole in the ground, and each morning the pole leaned in the direction the group was to travel that day. Emerging last, the Choctaw were granted the lands of their birthplace as their home.

Choctaws are closely associated with the Chickasaws, and many of their early legends indicate that the two tribes descended from a common people.
Apparently, after crossing the Mississippi, two brothers who had led the nation separated-the Chickasaws moving north and the Choctaws south. The Choctaw tribe was divided into two moieties, which consisted of six to eight clans. Each clan was further divided into local groups that might consist of a group of towns or a single village, or, in rare occasions, a part of a village.
These divisions dominated Choctaw social and ceremonial life.

At the beginning of the s, nearly , Native Americans lived on millions of acres of land in Georgia, Tennessee, Alabama, North Carolina and Florida—land their ancestors had occupied and cultivated for generations. By the end of the decade, very few natives remained anywhere in the southeastern United States. This difficult and sometimes deadly journey is known as the Trail of Tears. White Americans, particularly those who lived on the western frontier, often feared and resented the Native Americans they encountered: To them, American Indians seemed to be an unfamiliar, alien people who occupied land that white settlers wanted and believed they deserved.
The goal of this civilization campaign was to make Native Americans as much like white Americans as possible by encouraging them convert to Christianity , learn to speak and read English and adopt European-style economic practices such as the individual ownership of land and other property including, in some instances in the South, African slaves.
But their land, located in parts of Georgia , Alabama , North Carolina , Florida and Tennessee , was valuable, and it grew to be more coveted as white settlers flooded the region.

The Choctaw removal history is a long one, with removals dating as far back as the s and as recently as the s. The Trail of Tears was a term coined by the Cherokees about the period from when they were forced to give up their land in the southeastern United States and move west of the Mississippi River. The Choctaw Nation had removals in a more varied range than the Trail of Tears proper and prefers not to use the term.
In the late s, the Choctaw Nation was pressured by the U. After the Indian Removal Act was signed by Andrew Jackson, the Choctaw people realized they needed to move to maintain their relationship with the United States and become allies. They fought for America in the Creek wars and in the Battle of , according to the National Park Service, and were the first to sign a treaty with the federal government agreeing to relocate.
With the idea of Manifest Destiny being increasingly popular, the U. In , the Choctaws invited teaching missionaries to work among them in Mississippi. They started to build schools, but as this was happening, they were forced to cede more of the land that earlier treaties had given back to them. So they made the difficult decision to move. The removals were disorganized.
Some federal removal agents were helpful to the Choctaws, but others took advantage of them, which included stealing their money.

This case involves the status of twin illegitimate babies, whose parents were enrolled members of appellant Tribe and residents and domiciliaries of its reservation in Neshoba County, Mississippi. After the twins’ births in Harrison County, some miles from the reservation, and their parents’ execution of consent-to-adoption forms, they were adopted in that county’s Chancery Court by the appellees Holyfield, who were non-Indian.
That court subsequently overruled appellant’s motion to vacate the adoption decree, which was based on the assertion that, under the ICWA exclusive jurisdiction was vested in appellant’s tribal court. The Supreme Court of Mississippi affirmed, holding, among other things, that the twins were not “domiciled” on the reservation under state law, in light of the Chancery Court’s findings 1 that they had never been physically present there, and 2 that they were “voluntarily surrendered” by their parents, who went to some efforts to see that they were born outside the reservation and promptly arranged for their adoption.
Therefore, the court said, the twins’ domicile was in Harrison County, and the Chancery Court properly exercised jurisdiction over the adoption proceedings. Held: The twins were “domiciled” on the Tribe’s reservation within the meaning of the ICWA’s exclusive tribal jurisdiction provision, and the Chancery Court was, accordingly, without jurisdiction to enter the adoption decree.
